TERMS OF SERVICE
-
Overview
Welcome to Dozecloud. In these Terms of Service, “Dozecloud”, “we”, “us” and “our” refer to the store offering products and services through this website.
These terms govern use of our website and purchases made through it, together with our Privacy Policy and our Returns, Cancellations and Refunds Policy, available on the website.
Our store uses Shopify technology. Purchases are made with Dozecloud, not Shopify.
These terms are intended for international consumer sales. Nothing excludes or limits rights that cannot be waived under applicable law.
Contact: more.info.support@gmail.com.
-
Access and accounts
To make a purchase, you must have legal capacity to enter into a contract under applicable law.
You must provide accurate and sufficient information to process your order, including contact, payment and delivery details, and be authorised to use your chosen payment method.
If you use an account, protect your login credentials and notify us if you discover unauthorised use. You will not be responsible for unauthorised activity beyond what the law permits.
-
Products and information
We sell inflatable pillows intended for rest and comfort during travel or other uses described on the product page.
The applicable characteristics, materials, dimensions, included accessories and instructions are those stated for the product purchased.
Colours may vary slightly due to screens or lighting. This does not justify substantial differences from the description or limit rights concerning defective or non-conforming products.
Subsequent changes to product pages do not change the terms of purchases already contracted.
Use the product according to the instructions supplied. References to comfort or rest do not guarantee individual results or claim that the product prevents, treats or cures medical conditions.
-
Orders and acceptance
Before confirming your purchase, you can review the products, price and order details.
By submitting an order, you request the purchase and authorise payment of the stated amount. We will send an electronic confirmation. Unless the checkout process clearly states otherwise before payment, the order confirmation constitutes acceptance.
We may decline an order before accepting it for objective reasons, such as unavailable stock, inability to deliver, payment problems or reasonable indications of fraud.
If a problem arises with an accepted order, we will inform you and act in accordance with the law. We will not unilaterally change the agreed product or price.
If we cancel an order and do not supply the products, we will refund amounts collected without undue delay and within the applicable legal deadline.
-
Prices, taxes and payments
The applicable currency and amount will be displayed during checkout. Before you confirm the order, we will disclose the total price, taxes and shipping charges that we collect.
Prices will include mandatory taxes and charges where required by applicable law.
If customs duties or import charges not collected by us may apply, we will disclose their potential application and who is responsible before purchase, including legally required information about their calculation. We will not use this clause to impose costs that should have been included or disclosed beforehand.
Your bank or payment provider may apply its own currency conversion fees or other charges under your agreement with it.
Price changes do not affect accepted orders. Promotions are subject to conditions disclosed before purchase and will not reduce mandatory rights.
-
Processing, shipping and delivery
Available destinations, costs and processing and delivery timeframes will be disclosed during checkout or in the shipping information applicable to the order.
We may use external suppliers and logistics providers to prepare and ship products. This does not remove our responsibilities as the seller.
Estimated timeframes do not override agreed delivery commitments or legal rights concerning delay or non-delivery.
If we anticipate a material delay, we will inform you and provide any legally required options to accept a revised timeframe or cancel.
We bear the risk of loss or damage until you, or a person designated by you other than the carrier, physically receive the products. If you independently appoint a carrier we did not offer, the corresponding legal rules will apply.
If tracking indicates delivery but you have not received the order, contact us. We will investigate without suspending statutory remedy or refund deadlines.
-
Cancellations, returns and refunds
Detailed conditions are set out in our Returns, Cancellations and Refunds Policy:
https://dozecloud.store/policies/refund-policy
You may request cancellation before dispatch. If the order has not been dispatched when we receive your request, we will cancel it and refund the amount paid.
We do not offer voluntary change-of-mind returns where the law permits their exclusion. We respect mandatory withdrawal rights and remedies for defects, damage, errors and non-delivery.
For consumers protected by EU or UK distance-selling legislation, the general period for notifying withdrawal is 14 calendar days, subject to the applicable conditions and statutory extensions.
We recommend reporting damage or issues within 30 calendar days of delivery. This is not a warranty limited to 30 days or a general change-of-mind return right.
Any applicable more favourable specific conditions or statutory periods take precedence.
-
Warranties and consumer rights
Products must meet applicable legal requirements concerning conformity, quality, safety and fitness for purpose.
We do not exclude statutory warranties or applicable rights to repair, replacement, price reduction, refund or compensation.
Where Australian Consumer Law applies, products come with guarantees that cannot be excluded. For a major failure, you may choose a refund or replacement and claim compensation available under the law. For other failures, legally required remedies will be provided.
Customers in the United States and other countries retain mandatory warranties and rights under applicable law.
-
Shopify, external tools and links
Shopify provides the technology used to operate the store. Dozecloud handles orders and product complaints, without prejudice to Shopify’s or other providers’ own legal obligations.
The website may include external tools or links subject to their own terms. We do not control independent websites’ content.
References to third parties do not exclude our responsibility for services we engage to fulfil our obligations to you or require you to waive legally recognised claims.
-
Privacy
Our Privacy Policy explains how personal data is processed:
https://dozecloud.store/policies/privacy-policy
Accepting these terms does not automatically constitute consent to advertising, non-essential cookies or other processing requiring separate permission.
For privacy enquiries, email more.info.support@gmail.com.
-
Intellectual property
The website’s text, images, videos, designs, brands and other content belong to Dozecloud or their respective rights holders, as applicable.
You may use the website to obtain information and make purchases, and retain copies of documents relating to your orders.
You may not commercially exploit protected content without permission, except where permitted by law. These terms do not claim that Dozecloud owns patents, registrations or rights that do not belong to it.
-
Reviews and submitted content
If you publish a review or other content intended for public display, you must hold the necessary rights and truthfully describe your experience.
You retain ownership of your content. You grant us a non-exclusive, royalty-free licence to display, reproduce and technically adapt it to publish and present reviews related to our products. We will not change its meaning.
This permission does not turn private emails, complaints or documents sent to customer support into advertising content.
We may remove unlawful, fraudulent, irrelevant or rights-infringing content. We will not remove reviews merely because they are negative.
Any incentive connected with a review must be clearly disclosed.
-
Prohibited uses
You must not use the Services to commit fraud, impersonate others, harass, infringe rights, distribute unlawful content, introduce malicious software or access systems or data without authorisation.
You must not collect others’ personal data without a lawful basis or bypass security measures.
Automated tools must comply with the law and legitimate technical restrictions of the website without interfering with its operation.
These restrictions do not prevent complaints, legitimate opinions or the exercise of consumer rights.
-
Suspension of access
We may restrict or suspend access for a justified reason, such as fraud, a security risk or a serious breach.
The measure will be proportionate and, where possible and appropriate, we will communicate the reason.
Account suspension does not remove obligations concerning accepted orders, warranties, returns or outstanding refunds.
-
Availability and liability
We aim to keep the website operational, but maintenance or technical incidents may cause interruptions. This does not limit our obligations regarding purchases already made.
Each party is responsible for breaches and losses attributable to it under applicable law.
Nothing excludes or limits liability for fraud, deliberate misconduct, death or personal injury where liability cannot legally be limited, defective products or other mandatory liability.
Consumers are not required to provide a general indemnity merely for using the website or automatically pay our legal defence costs.
-
Errors and extraordinary circumstances
We may correct website errors for future transactions. If an error affects an existing order, we will inform you and act according to law, without imposing a higher price or a different product without your agreement.
If circumstances beyond our control prevent performance, we will take reasonable steps to reduce their effects and inform you. This does not remove statutory cancellation, refund or other remedy rights.
-
Applicable law and complaints
Applicable law and competent courts will be determined under the relevant legal rules, including consumer protection and private international law.
These terms do not impose exclusive foreign jurisdiction, mandatory arbitration or a waiver of legally available collective actions or procedural rights.
To make a complaint, email more.info.support@gmail.com. Contacting us is not a prerequisite to exercising rights before authorities or courts where the law does not require it.
-
Interpretation, changes and communications
If a provision is invalid or unfair, it will not apply, and the remaining terms will continue where legally possible.
These terms do not remove pre-contractual information, express commitments or rights on which you may legally rely.
Any transfer of our obligations will respect your rights and applicable notice or consent requirements.
The English and Spanish versions are intended to have the same meaning. No translation will limit applicable legal protection or impose English as a mandatory language for complaints.
We may update these terms for future transactions. Each purchase remains subject to the version accepted when the contract was formed, except for subsequent changes validly agreed or required by law.
We may send necessary electronic communications about orders, payments, shipping, returns and security. Marketing will be managed separately under applicable rules.
